Jonathan Houghton obtained a favorable Corridor Valuation decision from the New York Appellate Division, Second Department.

The decision is titled New York Central Lines v. State, 2016 NY Slip Op 05633 (2d Dep’t, July 27, 2016).

The decision will result in an award that will exceed $67 million dollars.  The State argued that the condemnee, CSX Transportation, Inc., was not entitled to any amount of just compensation.

This Second Department decision, along with a prior Second Department decision obtained as a result of this litigation,  New York Central Lines v. State, 101 A.D.3d 966 (2d Dep’t 2012), will establish the standards for valuing railroad corridors in New York State.
